if it's a trailer that was manufactured by a company or has been previously titled, you're in a bit of a gray area. technically and legally, you're supposed to follow the proper avenues to get a replacement/duplicate title from the last person it was titled to. that can be a pain if not impossible unless the person is readily available. however, you can easily play "dumb" and pass it off as a trailer that's never been titled before. it's next to impossible to not be successful. even if by some miracle you screw it up, all they'll do is deny your application. so, if you have knowledge it's been titled in the past, i guess it becomes a moral judgement call. do the means justify the ends so to speak. personally, i have no problem with it. the same goals are still reached either way. the state still gets their money, you've done the "right" thing by making it legal, you're able to register/tag it, it's able to be identified in the event it's stolen, and you're able to pass it off to a new owner in the future with no problems.

Would it be stupid to pick this trailer up without getting a title for it? here

no, unlike cars, trailers are pretty easy to get new titles for. you need to make sure it has no serial numbers on it, manufacturers name, etc. though. or, if it does, make sure you can remove them. you might just get a bill of sale from the seller to prove that you paid for it and what the amount was, but even that's not really needed. Well, the last trailer I was looking at never worked out. Recently I found another trailer that I really like, its very heavy duty and looks to be exactly what I need. more

I called the seller, he seemed like a decent older guy and was up front with me about it not having a title. He said it would be about $80 to get one for it. [links]

so, the process is as follows: you'll go to the dmv and tell them you have a custom/homebuilt trailer and you need to get it titled. they will give you a number and some paperwork to fill out. you will have to stamp or use weld beads to put the number on the trailer. they'll tell you where to put it. then, you'll carry the trailer and your paperwork to a dmv facility that has an officer (license place, weigh station, whatever) or anywhere you can find a state trooper. they will inspect it to make sure it's legal/roadworthy, check to make sure there are no existing serial/id numbers, and make sure you have put the new number on correctly. if all is well, they'll sign off on your paperwork. it's submitted to the dmv, you pay your title/tag fees, and you'll get your new title in a week or two. here

Boat registrations commonly are transferable.
Trailer and the other automotive registrations (License Plates) generally are NOT transferable.
You can usually transfer them to another (the New) trailer that YOU own, but not to another person. [links]

Signing over the title(s) should do it. Check your local laws, etc accordingly, but the 'bank' stuff is pretty consistent throughout.

Here you go. Directly from the real NCDOT website:

I did eventually get to talk to someone at the DMV, and they said that even though a title is not required in NC, because it is possible to title a trailer there, it must come with a SC title when bought to be able to be registered in NC. So I can't buy it unless this guy can get a title. He did not get a title from the person he bought it from, so who knows. [links]

Next question, if that is true, how would I go about obtaining a title and registering it in NC?

WOW! I might as well buy a brand new trailer at that point. here

For a home built trailer head to the tag office and tell them you want to register a home built trailer. They will ask a few questions then issue you a vin number and form to have signed by Highway Patrolman. You have to get the trailer tongue and axle stamped with the vin number. more

You then take it to a Highway Patrol office for them to inspect the stamps, check the lights etc.. If it all works they sign the form and you take it back to the license plate office and they'll get you a title and tag.

I want to build a trailer to tow behind my car, its going to be small. I know I have to register it like I do a car.

You should've taken pictures of the building of the trailer to prove that you made it. In theory all you would have to say if you got pulled over, would be that you were on you planned to get it registered tomorrow.

Electric brakes are the most commonly used today. They are wired into the braking system of the vehicle and activate in unison with the vehicle’s brakes. There is also an in-cab controller which needs to be installed by a qualified technician; this device allows the trailer brakes to be engaged when you press the vehicle brake pedal, and adjusted up or down to meet the payload weight. Majority of trailers have leaf-spring axles; however, torsion axles have been increasingly used due to their superiority in longevity, stability, and safety. Leaf springs provide cushion in a trailer’s suspension by attaching to axles with U-bolts. On torsion axle trailers, the cushioning function is built into the axle. Self-contained and sealed, torsion axles resist rust and corrosion better than traditional leaf spring axles. Torsion axle trailers lower the center of gravity of the load you are hauling, thereby providing more stability for the trailer, but if you have a flat tire a torsion axle requires a spare wheel before you are able to continue pulling the trailer. A torsion axle trailer also has the drawback of a low variable-rate, giving less flexibility when loaded or going over harsh terrain. Some experts say that leaf springs are the better option while torsion axles are the best option.

It is very important that when your trailer is loaded that it is as level as possible. If the trailer is not level, the suspension system in the axles can be damaged, or the tires on one axle may be overloaded. Measure the distance from the bottom of the trailer frame at the front and rear of the trailer on a level surface and compare the measurement. The measurements should be nearly equal. This should be done with the trailer in a loaded condition. If the measurements are not equal, the gooseneck stem or the hitch on the towing vehicle will need to be adjusted.
